IN ATTENDANCE: Elli Dalrymple,
Debbie Riddle, Susan Matonis, Debra Hobbins, & Heather Hanson.
MINUTES: Meeting took place at the Salt Lake
County Building to address Sunnydale Residents concerns.
First item, the Clarification of the Application Process.
Emigration Planning Commission would be used if Conditional
Use.
A Permitted Use
application is processed through Board of Adjustment and County
Planning and Development Services Division is for Permitted Use.
The parent file (single family home) is a permitted use and therefore
will not go through any planning commission. This development
is permitted use.
The ordinance prohibiting the Planning Commission from approving
development, other than roads, on slopes >40% does not pertain
to the Board of Adjustment. The Board of Adjustment has its own
Chapter.
The approval of the variance to develop land on the slope of 40-50%
is not tacit approval of same, it merely allows the owner/builder/developer
to ask the question, “Can I build a home her?” This
question is “asked” by submission of the file, i.e.
the green sheet.
Questions posed to County were noted as follows:
Who are the members of the Board of Adjustment?
This is not public knowledge, not allowed to provide names. However,
could come to a meeting and see them and their names. If I wanted
to speak to one of them I would have to come to a Board of Adjustment
meeting and meet with them there since I am not allowed to know
their identity prior to that time.
There are 6 members of the B of A, 2 alternates, and 4 constitute
a quorum.
If you wanted to speak to a B of A member who gave a dissenting
opinion. you are required to go to a B of A meeting and meet them
there only. Per the rules, there should be no contact on matters
post decision.
May I have a copy of the Process Sheet for someone building
a home?
The process chart first requested is the process sheet for Conditional
Use. The appropriate process sheet is the green one given today,
that is for Permitted Use.
Where can I get information about the septic requirements, etc.?
Health Department. Jerry Bourke.
I understand that any appeal to this process would be handled
by the 3rd District Court. What is the process to appeal?
Contact the 3rd District Court.
What were the 2 requirements for #23032 has to meet for the
approval of the variance to build on a slope >40%?
Complete the main application (the
green sheet)
Stay within the limits of disturbance that are shown on the submitted
plan.
Do I have access to the results of:
soil tests,
avalanche path tests,
tests for potential for avalanche and landslide?
The geotechnical study results are copyrighted. I can obtain the
name of the person who did the study from Elli and contact them
and request results—there may be a charge or they may refuse.
I could contact Elli and make an appointment to examine the file
with the results of any tests. I could not take pictures or make
copies, but I could take notes.
Who do I contact to discuss fire safety issues and requirements?
Stuart Gray of the Unified Fire Authority. He could help me access
the code. Water tanks have been “out” for some time.
Builder proposes sprinkler with 300 gallons in a water tank. I’m
not sure of the gallons for his sprinkler system – that is
calculated during PU process with the fire dept.
Who could I contact for legal questions regarding liability
for a landslide, etc?
Contact the county district attorney’s office and ask for
the attorney who is working with the B of A/Planning Commission.
Does the builder have a well?
Unknown. He will have to provide water availability to proceed forward.
Because someone has a well, does that mean he has water rights?
No
Does he have water rights?
That will be determined by __________Health Dept (see water availability
question)
Is there a list of wells in my area and water rights attached to
each well?
Contact Jerry Bourke of the Health Department for a list of wells.
Who is liable for the loss of life, property, and property damage
when the home, file # 23032, slides down the hill?
The geotechnical expert is where the buck stops. The geotechnical
engineer certifies his work but the court system would ultimately
decide who is responsible if such a disaster occurs.
DEBRA'S SUMMARY:
The bottom line for me as a homeowner is that when this home slides
down the hill, destroys my lot, possibly my home, possibly kills
family members, I will be in the courts for years while I have no
place to live, a 500K mortgage, and possible dead family members.
My homeowners insurance does not cover landslides, even those caused
by a home sliding into my home. Who pays my mortgage, gives me a
place to live, replaces all my property, pays for the funerals?
No one knows how long it will take in the courts.
We all know that nothing happens fast in the courts. Other
cases such as this have taken years.
My friends live below me. If I am spared, their homes may be buried
because they are at the bottom of the hill. Their property, everything
they have worked for for their entire lives will be lost. Possibly
their lives will be lost.
An engineer looked at the plans, the lot, and informed the residents
of the area that it is not a question of if the home will slide
down the hill, but when. He noted it would be a catastrophic
event, one that would take place without warning.
ACTION ITEMS:
Request copies of items submitted to BOA at hearing.
Obtain Maps.

MINUTES: Meeting was held for residents to
assess situation at home of Debra Hobbins at 3913 Cove Road
Questions Posed were noted as follows:
Ownership of Easement & what could cause the fire marshal to
relinquish the county's right to the firetruck turn-around.
Possibility of Setting Up Escrow Account to pay for road damages
post construction.
What are plans for Zoning remaining 17 acres if the lot were to
be joined with surrounding acreage in the future.
Mothers Day 1984 landslide was revisited.
Dan Boone had questions regarding brush clearing & right of
way through creek beds.
Colleen Wood mentioned there was government grant money available
for brush clearing and that she had used it.
ACTION ITEMS:
Get estimates for the costs to repair the road.
Seek legal counsel.
